RICHARD CARPENTER
CERTIFIED TAX LAW SPECIALIST
NAMED A 2008 "SUPER LAWYER"

WHEN DEALING WITH THE IRS, EXPERIENCE IS CRITICAL
AND RESULTS ARE WHAT COUNT
... THAT'S THE BOTTOM LINE.

IRS COLLECTIONS

The Internal Revenue Code gives IRS Revenue Officers tremendous power to collect past due tax, interest and penalties from a late-paying taxpayer. The IRS can levy against a taxpayer's wages, bank accounts, retirement plans, escrow accounts and accounts receivable. The IRS also has the power to seize taxpayer assets and sell them off to pay outstanding amounts due.

Be advised that the IRS regularly files tax liens against taxpayers who can't fully pay their tax obligations, and these tax liens show up on a taxpayer's credit report and adversely affect their ability to obtain any form of future credit. However, a skilled tax attorney, experienced in IRS tax disputes, can utilize certain proven techniques to protect a taxpayer's rights and give them needed time to "catch up" with their payments. If you are the subject of an IRS tax collection effort, or have other tax problems, San Diego tax attorney Richard Carpenter can help you.

DID YOU KNOW THAT ...

  • An assessment must first be made before the IRS is permitted to take collection action.
  • Every Revenue Officers has wide latitude in deciding what collection action is taken against a taxpayer.
  • Negotiation skills plan an important part in successfully resolving an IRS collection matter.
  • The IRS must provide a taxpayer with at least 30 day written notice before being allowed to levy.
  • The IRS can hold an individual taxpayer personally liable for a large portion of a corporation's nonpayment of payroll taxes.
  • The IRS can issue a Summons requiring a taxpayer to personally appear to provide testimony and documentation concerning their assets.
  • A tax lien is a public record that the taxpayer owes money to the IRS or California.
  • The IRS generally has only 10 years from an assessment to collect delinquent taxes.
  • Under limited circumstances, a taxpayer can discharge income taxes in bankruptcy.

SAN DIEGO TAX LAWYER RICHARD CARPENTER CAN HELP BY ...

  • Setting a game plan which provides the most effective solution to a taxpayer's IRS collection matter.
  • Defending against any IRS attempt to hold a taxpayer personally liable for a corporation's nonpayment of payroll taxes.
  • Communicating directly with the Revenue Officer, so that a taxpayer never has to meet with him/her.
  • Determining whether an Offer-In-Compromise is a taxpayer's best option. (Note: please see my separate Offer-In-Compromise section for additional details.)
  • Determining whether a monthly repayment plan allowing a taxpayer time to "catch up" is the best option.
  • Utilizing, when appropriate, a taxpayer's Collection Appeal Rights and Collection Due Process hearing rights.

RICHARD CARPENTER's EXPERIENCE ...

Since 1984, I have successfully represented more than one thousand clients in resolving their IRS tax disputes. While the circumstances of every IRS collection matter differ, there are certain proven techniques that I use to obtain the best possible results for a taxpayer.

I am a part-time tax law professor, a Certified Tax Law Specialist, and the author of 14 published articles, one of which is a leading article concerning IRS Collections ("GET THE BEST DEAL FOR CLIENTS FROM THE IRS COLLECTION DIVISION", published in Taxation For Accountants, August 1998 issue, and republished in Taxation For Lawyers, September/October 1998 issue).

Unlike some tax controversy defense attorneys, I did not start out my legal career as an IRS attorney using the Tax Code against honest taxpayers. I also did not start out my legal career as a federal prosecutor working to put good people in prison for some mistakes on their tax returns. Instead, I have devoted my entire 24+ year legal career helping to defend hardworking, family-oriented taxpayers against the far and powerful reaches of the Internal Revenue Service and I am proud of that accomplishment. Being an effective tax controversy defense attorney is a mindset and I have had that tax defense mindset for my entire 24+ year legal career.

WARNING: Tax law is complex. Thus, it is very important that you hire only an experienced, State Bar Certified, tax attorney to represent you and that you carefully review their background before you hire them. I recommend a minimum of 15 years of tax controversy defense experience. Don't be fooled by some glitzy looking "tax-help" website. As you may have already noticed, many of those websites intentionally avoid listing the background of the tax person who will be working on your case because he / she is either a novice attorney, or worst yet only a para-legal or an accountant.

Successfully solving tax law problems requires skill, plus tax law knowledge and years of experience. It is certainly not a job for a novice attorney. To protect yourself, you should hire only a tax attorney who is a Certified Tax Law Specialist by the State Bar. Remember, there is no such thing as a routine call or letter to the IRS. A skilled Certified tax lawyer will tailor each communication precisely to your specific tax defense plan. Each communication to the IRS means something and it is very important that nothing is overlooked or taken for granted.
