CERTIFIED TAX LAW SPECIALIST
NAMED A 2008 "SUPER LAWYER"

WHEN DEALING WITH THE IRS, EXPERIENCE IS CRITICAL
AND RESULTS ARE WHAT COUNT
... THAT'S THE BOTTOM LINE.

UNITED STATES TAX COURT

The United States Tax Court hears 95% of all IRS tax disputes decided by a Court. It is imperative for any taxpayer who has an IRS tax dispute heading towards the United States Tax Court to hire an experienced tax attorney who has a solid understanding of the United States Tax Court's more than 200 unique and technical Court rules. The job of the Tax Court is to determine the correct amount of tax. Thus, it is possible for an unprepared taxpayer to wind up owing more tax than the IRS initially asked for. If you are involved in a dispute in the United States Tax Court, San Diego tax attorney Richard Carpenter can help you.

Warning: filing a Tax Court Petition just one day late can invalidate a taxpayer's entire case, allowing the IRS to make an immediate assessment.

DID YOU KNOW THAT ...

  • A taxpayer needs a Notice of Deficiency "ticket" to go to Tax Court.
  • A taxpayer only has 90 days after the Notice of Deficiency is mailed to file a Petition with the Tax Court.
  • There is a special 150 day exception rule that may assist a taxpayer when filing a Tax Court petition.
  • The IRS is required to mail its Notice of Deficiency to a taxpayer's last known address, or it could invalidate it.
  • The United States Tax Court is headquartered in Washington, D.C., but it visits 62 select cities.
  • A taxpayer who timely files a Petition with the Tax Court does not have to prepay the disputed tax before the Court hears their case.
  • Jury trials are not permitted in United States Tax Court.
  • Under Tax Court rules, a taxpayer generally has the burden of proving the IRS wrong.
  • There are other courts available to resolve an IRS tax dispute.

SAN DIEGO TAX LAWYER RICHARD CARPENTER CAN HELP BY ...

  • Evaluating a taxpayer's entire case to determine if the United States Tax Court is the best option.
  • Performing all necessary tax research to determine if there are similar cases that will help a taxpayer's position against the IRS.
  • Determining if a taxpayer has any exposure to a greater tax liability by utilizing the United States Tax Court.
  • Timely filing all required United States Tax Court documents within the strict statutory time periods.
  • Using my negotiating skills to see if a favorable settlement prior to trial can be reached.
  • Effectively litigating the case in United States Tax Court, if a trial is the best option for a taxpayer.

RICHARD CARPENTER's EXPERIENCE ...

Since 1984, I have successfully represented more than one thousand clients in resolving their IRS tax disputes. I teach Tax Court litigation techniques to aspiring tax attorneys as a part-time tax law professor at the University of San Diego school of law.

I am a Certified Tax Law Specialist, and the author of 14 published articles, one of which is a leading article concerning the Tax Court ("WHAT ACCOUNTANTS NEED TO KNOW ABOUT THE TAX COURT", published in Taxation For Accountants, February 1998). I have the knowledge and 24+ years of experience dealing with every facet of Tax Court litigation.

Unlike some tax controversy defense attorneys, I did not start out my legal career as an IRS attorney using the Tax Code against honest taxpayers. I also did not start out my legal career as a federal prosecutor working to put good people in prison for some mistakes on their tax returns. Instead, I have devoted my entire 24+ year legal career helping to defend hardworking, family-oriented taxpayers against the far and powerful reaches of the Internal Revenue Service and I am proud of that accomplishment. Being an effective tax controversy defense attorney is a mindset and I have had that tax defense mindset for my entire 24+ year legal career.

WARNING: Tax law is complex. Thus, it is very important that you hire only an experienced, State Bar Certified, tax attorney to represent you and that you carefully review their background before you hire them. I recommend a minimum of 15 years of tax controversy defense experience. Don't be fooled by some glitzy looking "tax-help" website. As you may have already noticed, many of those websites intentionally avoid listing the background of the tax person who will be working on your case because he / she is either a novice attorney, or worst yet only a para-legal or an accountant.

Successfully solving tax law problems requires skill, plus tax law knowledge and years of experience. It is certainly not a job for a novice attorney. To protect yourself, you should hire only a tax attorney who is a Certified Tax Law Specialist by the State Bar. Remember, there is no such thing as a routine call or letter to the IRS. A skilled Certified tax lawyer will tailor each communication precisely to your specific tax defense plan. Each communication to the IRS means something and it is very important that nothing is overlooked or taken for granted.

EXPERT GUIDANCE ...  Many tax attorneys and CPA's look to San Diego Tax Attorney Richard Carpenter for expert guidance in helping their clients resolve serious tax problems with the IRS.
